Terms of Service for Movetain

These terms describe use of the Movetain Android app, web portal and Relay service, provided by an individual developer. Contact: [email protected]. Read these terms and the Privacy Policy before using online features.
1. An auxiliary outdoor tool
Movetain supports route recording, planning and communication. It is not a certified navigation, rescue, medical or life-safety system, and the operator does not monitor your journey or provide emergency dispatch. You remain responsible for assessing terrain, weather, equipment, physical condition and the suitability of a route. Carry independent navigation and an appropriate means of contacting emergency services.
2. SOS, radio and connectivity limitations
An SOS marker or message in Movetain does not automatically contact emergency services or guarantee rescue. It depends on connected devices, compatible configuration, power, radio coverage and the availability of the network and recipients. A delivery indication does not establish that a person has read the message or will act on it.
LoRa and gateway communication can be delayed, interrupted or unavailable because of terrain, distance, interference, antenna placement, firmware, internet access or power loss. Do not rely on Movetain as your only emergency communication method. Follow the radio-frequency, power and equipment rules applicable where you operate.
3. Maps, positions and route estimates
Maps, trails, elevation profiles, GPS positions, weather and calculated statistics may be inaccurate, incomplete or outdated. A displayed trail is not confirmation of access rights, safe passage or current conditions. Verify critical information using independent sources. Sensor and heart-rate statistics are not medical advice or a diagnosis.
4. Accounts, invitations and acceptable use
Keep your account and room keys secure. Share invitations only with intended recipients and use the appropriate role. Do not access another person's data without authorization, attempt to bypass permissions or limits, disrupt the service, upload unlawful material, or use the system to harass or track people without a lawful basis. Obtain the permissions needed to upload photographs or data relating to others.
You retain rights in your content. You authorize the processing, storage and transmission needed to provide the features you choose, subject to the Privacy Policy and applicable law. This is not permission for unrelated use of your content.
5. Availability, limits and backups
Features may depend on third-party services and hardware. There is no promise of uninterrupted service, permanent storage, universal device compatibility or error-free operation. Account quotas, retention limits and operational restrictions apply. Keep your own copies of important recordings. Local deletion, cloud deletion and room reset are different operations; read the confirmation before deleting data.
The operator may restrict access to address abuse, security risks or service-capacity problems and may maintain, change or discontinue features. Notice will be provided where reasonably practicable or legally required. Any separate paid-service terms and mandatory consumer rights remain applicable.
6. Warranties and limitation of liability
To the extent permitted by applicable law, the service is supplied “as is” and “as available”, without additional warranties of fitness for a particular journey, accuracy, availability or successful message delivery. You should not make safety-critical decisions solely on its output.
To the extent permitted by applicable law, the operator excludes liability for indirect or consequential loss, lost profits, and loss arising from reliance on inaccurate third-party maps or unavailable communications. This clause does not exclude or limit liability that cannot lawfully be excluded or limited, including applicable mandatory consumer rights, fraud, intentional misconduct or other protected claims. It does not transfer the operator's mandatory legal duties to you.
7. Privacy, changes and disputes
The Privacy Policy explains actual data handling, cloud services, retention and deletion requests. Acceptance of these terms is separate from any consent that may be needed for particular processing.
Updated terms will identify their version and date. Material changes will be notified and acceptance requested where required; publication alone does not retrospectively waive your rights. Mandatory applicable law and legally competent courts are not displaced by these terms. Please contact [email protected] first so we can try to resolve a concern.
